Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the 3D Baby Viewer mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the revised Terms.

2. Description of Service

3D Baby Viewer is a mobile application that transforms prenatal ultrasound scan images into 3D visualizations. The App is designed for entertainment and emotional bonding purposes for expectant parents and their families.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating an account.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree to use the App only for its intended purpose and in compliance with all applicable laws. You shall not:

• Use the App for any unlawful or unauthorized purpose
• Upload content that is not a legitimate ultrasound image or related prenatal imagery
• Attempt to reverse-engineer, decompile, or disassemble any part of the App
• Circumvent or disable any security features of the App
• Use the App to transmit any malware, viruses, or harmful code
• Interfere with or disrupt the integrity or performance of the App
• Use the App's output for fraudulent or misleading purposes
• Resell, sublicense, or commercially exploit the App without authorization

6. Intellectual Property

6.1 Our Property

The App, including its design, code, graphics, logos, algorithms, and documentation, is the exclusive property of 3D Baby Viewer and is protected by intellectual property laws. All rights not expressly granted are reserved.

6.2 Your Content

You retain ownership of the ultrasound images you upload and the 3D visualizations generated from them. By using the App, you grant us a limited, non-exclusive license to process your images solely for the purpose of providing the App's visualization services.

7. In-App Purchases & Subscriptions

• Certain features may require in-app purchases or subscriptions.
• All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.
• Subscription renewals are automatic unless canceled at least 24 hours before the end of the current billing period.
• Refund requests must be directed to Apple in accordance with their refund policies.
• Prices are subject to change with reasonable notice.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection, use, and protection practices.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OF 3D VISUALIZATIONS
• WARRANTIES THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS

The 3D visualizations are approximations based on 2D ultrasound data and may not accurately represent the actual appearance of the fetus. Results may vary depending on the quality of the input images.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3D BABY VIEWER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, goodwill, or other intangible losses
• Any damages arising from your use of or inability to use the App
• Any medical decisions made based on the App's visualizations

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless 3D Baby Viewer and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the App is immediately revoked
• You must cease all use of the App
• We may delete your account and associated data
• Sections of these Terms that by their nature should survive termination will remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic. The operator of the App is 3D Med Visions s.r.o., registered at the Regional Court in Ostrava, file number C 95697.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
